Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if that age is higher, to use the Site or place an order. By using the Site, you represent that you meet these requirements.

2. Accounts

When you create an account, you agree to provide accurate, complete, and current information. You are responsible for safeguarding your password and for activity that occurs through your account. Do not disclose your password to another person, and notify us promptly if you suspect unauthorized access or another security breach.

3. Products and orders

• Product descriptions. We work to present product descriptions, colors, dimensions, materials, photographs, availability, and prices accurately. Handmade pieces may have small variations, and displays may render colors differently.
• Pricing. Prices are shown in U.S. dollars and may change without notice. We may correct pricing, typographical, or listing errors and cancel an affected order.
• Order acceptance. An order confirmation acknowledges that we received your order; it does not guarantee acceptance. We may refuse or cancel an order because of availability, suspected fraud, listing errors, or another legitimate reason. If payment has been captured for a canceled order, it will be refunded.
• Payment. Available payment methods are displayed at checkout. By submitting an order, you represent that you are authorized to use the selected method.
• Taxes. Applicable sales tax is calculated based on the order and shipping destination as required by law.

4. Shipping and delivery

Shipping methods, costs, estimated timing, address responsibilities, and international-order terms are described in our Shipping Policy. Delivery estimates are not guarantees. Risk of loss and title pass as provided by applicable law.

5. Returns and refunds

Eligibility, timing, exclusions, and instructions for return and refund requests are described in our Refund Policy.

6. Intellectual property

The Site and its original content, features, and functionality—including jewelry designs, photographs, text, graphics, logos, and software—belong to My Treasure Heart or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, distribute, modify, publish, or commercially exploit this material without prior written permission, except where the law permits.

7. User content

If you submit a review, comment, photograph, or other material (“User Content”), you grant My Treasure Heart a non-exclusive, royalty-free, worldwide license to use, reproduce, adapt, publish, translate, distribute, and display that User Content in connection with our business and Site. You represent that you own or control the rights needed to submit it, that it is accurate, and that its use will not violate another person’s rights or applicable law.

8. Prohibited uses

You may not use the Site to:

• violate any applicable law or regulation;
• harm, exploit, harass, or impersonate another person;
• send spam, chain letters, or unauthorized promotions;
• introduce malware or attempt to gain unauthorized access to the Site or another account;
• scrape, interfere with, overload, or disrupt the Site; or
• engage in conduct that restricts another person’s use of the Site or exposes My Treasure Heart or its customers to harm or liability.

9. Disclaimers

To the fullest extent permitted by law, the Site and its content and services are provided “as is” and “as available,” without express or implied warranties. My Treasure Heart does not warrant that the Site will always be uninterrupted, error-free, secure, or free of harmful components. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

10. Limitation of liability

To the fullest extent permitted by applicable law, My Treasure Heart and its owners, employees, agents, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, use, goodwill, or other intangible losses arising from the Site or these Terms. Our total liability for a claim relating to the Site or these Terms will not exceed the greater of the amount you paid to us during the 12 months before the claim or $100. These limits do not apply where prohibited by law.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless My Treasure Heart and its owners, employees, contractors, and agents from claims, damages, losses, liabilities, and reasonable costs arising from your misuse of the Site, your breach of these Terms, or User Content you submit.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. If a provision is held invalid or unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of that provision.

13. Dispute resolution

Before filing a formal claim, please contact us and give us a reasonable opportunity to resolve the issue. Except where applicable law provides otherwise, a dispute arising from these Terms will be resolved in Sacramento County, California. Nothing in this section prevents either party from seeking appropriate injunctive or equitable relief, filing an eligible claim in small-claims court, or exercising a right that cannot legally be waived.

14. Changes to these terms

We may update these Terms from time to time. The revised Terms become effective when posted unless a later date is stated. When appropriate, we will provide additional notice of a material change. Continued use of the Site after the effective date means you accept the revised Terms.
